    Hi All, we got our physical cards yesterday my USPS.
    PD: Feb 16th, 2006, NSC, EB2-I, RD: Aug 6th 2007
    Got Welcome notice by USPS o Aug 16th (approved on August 10th), online status changed to PDA on August 19th, got physical cards yesterday.

    No. Tried to call NSC a few times and got diffferent stories on why my fp notice is being dealyed. I gave up trying after my last call 2 weeks ago wherein an IO told me to wait until middle of May.

    Mine is like your's - NSC - CSC - NSC. My I-485 receipt number starts with WAC. No FP notice yet. Who knows what they are doing.

    Hi All,

    I have a question about invoking AC21 using EAD vs AC21 using H1B.

    My status is as follows:
    - approved 140 from a BIG company with BIG lawyers, but company going down.
    - more than 180 days since filing 485
    - H1B valid till March 2010.
    - I have been on H1B since 2001
    - WILL BE LAID OFF THIS WEEK.

    I do not know if my sponsoring employer will revoke my 140, but I believe it should not matter.

    My question however is regards to the EAD/H1B usage after revoking AC21.

    I may get an offer from a company that is small with limited funding. They are not willing to do my H1B and want me to use EAD. I wanted to keep my H1B valid, but the company will make me pay for it. And given that I will have to apply for extension soon, I will have to pay for it again. So monetarily, its not good for me.

    So I thought of using EAD for the new job. But if I want to get back to H1B later, i have the following questions:

    1. Can I go back to H1B again after using EAD
    2. Will I be subjected to the cap?
    3. What should I do to get back to H1B?
    4. Can I do it without leaving the country?
    5. Will the financial of the new company matter. Its a valid startup and my job will be similar. I will take a pay cut, but I believe it should not matter for AC21.
    6. Any other advice, anyone?

    I would really appreciate if someone could help me out.

    my opinions in bold
    Both parties ( employee and employers) bend letter and spirit of law. Think fake resumes, references, experiences on employee side. Think no salary on bench, lack minimum professional decorum, professional ethics on employers side. But overall my sympathies are with employee and more so in this case.

    In > 90% of cases I have seen, Desi employers dont operate on good faith. A good example is punitive damages. The employer does h1B, incurs about 5K cost and expects the employee to serve out 12 months. The exit clause is 25K. Its downright silly and precisely what causes employee anxiety. Instead if it is prorated for stay, it would be fair for every one involved.

    -- 25k because its just not about H-1b costs. Its business. Business needs to make profits and be healthy. Business dont want H-1B employees who would like to stay for less than an year. It affects other H-1B employees and their immigration process. Businesses hate to ask H-1Bs from INS and cancel H-1s. It puts a blotch on the Business. Afterall INS give H-1B approval hoping that the employee works with the employer for atleast 3 years .


    Hoarding I-140, labor certificatio etc and giving no visibility is another deal breaker.I just dont get it.

    you are right but this is also forced by H-1B employees.

    Some one commented its a small world, apologize if necessary blah blah. If, for a minute the employer in this case thinks in positive way, ( My former employee would be at this place, couuld be in a position where I can sell more, i could get referral for new employees) he wouldnt be doing something like this which downright irresponsible and can cause significant damage to his shareholders. Being a small world goes on both sides.

    Thats pretty optimistic and long term thinking.

    For a techie, clilent is king. I would never displease the ultimate beneficiary of my services. Even after my project is over, I keep in touch, do occasional free consulting all in hope of building my network. But for employers like these, who add no value, i have no sympathies.

    Well, culture has tremendous impact on people. Looking at the state of our country, what have we become in last 63+ years? Major percentage of population still live under poor living conditions. We are one of the most corrupted countries in the world. Some people want to live in denial. Boasting about greatness that doesn't exist is of no use to the current and future generations. We have to make our country great by changing the conditions. In order to do that, first we need to acknowledge that there are serioous issues. Unless we all unitedly agree that the conditions are pathetic and will worsen, nothing is going to change.

    Agree 100%. You have to acknowledge that there is a problem before you can fix it. And I have no shame in accepting that there are problems. I am also proud of where India has reached in the last 20 years or so (especially since some of the purely socialist policies became capitalist leaning). Today Indians are giving Americans some serious and tough competition for jobs, not an easy feat. According to me, things are always grey - there is no black and white. So be proud of your achievements, and learn to accept problems and work on them is my motto in life.

    I consider myself a pro-business and a not-so-emotional person. I go where I see a business opportunity. Right now I see great opportunities waiting to be grabbed in India, and I am going back in pursuit of them. India or the US - I know that I will be happy in either place. Like someone said earlier, happiness can be found anywhere, as long as your priorities are straight and you know what they are.

    So you were not referring to Employment Letter for GC job, rather Current Employment Letter while discussing how to file I-485.
    GREAT!!! I hope you are not filing your I-485 application yourself.

    What is the Current Employment Letter has to do with I-485?

    My employer says EVL is not required for 485 filing. How do I make him understand that it is required? Any links from USCIS website or any authentic info will be helpful. I searched and couldn't find it!! TIA

    Additionally , I saw a post about "5 reasons to not contribute" that was a gud one. I will bump that one up ...I am surprised that we cant get a 1000 people to contribute some money..An avg of $50 will get us beyond $50,000 (Obviously we dont need even 1000 people because many will contribute 100 or more) ..There just too many leaches who wait for others to do thier job..

    Months in 2005, 2006 and 2007 when ALL AOSs were not acceptable.
    Months in 2005 and 2006 when ANY AOS was not acceptable.

    My EAD renewal is pending as well - RD 6/18 - present EAD expiring on 9/25. I requested expediting processing on 8/13 and received a letter yesterday saying they are reviewing my request and will have a decision in 60 days : :rolleyes:

    We CANNOT do any thing, when I called USCIS, IO said they can't do either.. wait for 60 days. BS

    I think it's tough for anyone to predict exact EB3 -> EB2 porting for this year at this point in time....It's definitely going to increase every year...unless some rule changes...It was pretty clear even before this lawyer posted that EB2 will have no or very slow movement without any spillover...

    A person has been with a company for 10 years as a Test Lead and is promoted to a position of a manager and the Lead expects that on the first day of being a manager he wants all the rights and benefits of being a manager for 10 years even though he has been a lead for all of those 10 years.

    Great analogy... Please send it to USCIS and lawmakers. I am sure they will listen to you. :D

    what you are hoping for is a change in law which one cares about because it is absurd.

    brickbats and concerns apart few people believe in the concept and are ready to put the money where their belief lies. So if you can do something about it do it. Other suggestions are ok may be they can be made in the other thread where there is a discussion about media attention.

    Gandhi - giri works everywhere and it has worked in this country too, have you heard about civil disobedience in this country too.. if you did not then you might want to use our fav : google and look it up. - Rosa parks , does that ring a bell? sometimes simple things take you farther than highly publicized event.
